农民专业合作社产权制度的法律思考

Legal Constderation on Property Rights Sytem of Farmers' Specialized Cooperative

当前,农民专业合作社产权制度存在很多不完善的地方,已经成为制约我国农民专业合作社进一步发展的瓶颈因素。完善农民专业合作社产权制度相关立法是农民专业合作社规范化、制度化的基本要求。农民专业合作社产权制度立法存在的主要不足:资产存在不确定性;成员非货币出资方式的规定不完善;利益分配机制缺乏激励性。农民专业合作社产权制度的立法完善:增强资产的确定性;完善成员非货币出资方式;完善利益分配机制。

At present, there are many imperfections in the property rights system of farmers＇ specialized cooperative. In order to increase level of legal and regular of the property rights system of farmers＇ specialized cooperative, we should analysis and improve these imperfections from the rule of law. these imperfections in the property rights system of farmers＇ specialized cooperative include the following： the uncertainty of property of farmers＇ specialized cooperative ; the imperfections of the provisions of non-monetary contribution; the lack of motivation in benefit distribution mechanism. The legal measures of the imperfections include the following： to enhance the certainty of assets;to perfect the provisions of non-monetary contribution; to perfect the benefit distribution mechanism.
