当前预防职务犯罪工作的难点与对策

Solutions to the Plight of Preventing Duty Crimes

通过问卷调查、座谈等方式进行实证调研,对目前预防职务犯罪工作的现状进行剖析,认为当前预防职务犯罪工作的表现有群众监督难、检察机关办案难、惩处贪腐轻刑化和法制教育效果不佳,而其根源在于立法科学性不足、权力配置与布局不合理、审判员自由裁量权过大和社会正气不足等。走出当前困境的几点建议是立法预防、体制预防、监督预防和教育预防。

Based on questionaire and seminar, this paper has done research into the current plight of preventing duty crimes, which has difficulties in such aspects as public supervison, prosecution, light punishment of corrup- tionm, and poor legal education. The roots are less scientific legislation, unreasonable power layout , judge＇s discretion and lack of social ethics. Solutions to the plight include preventions in legislation, institution, supervision and education.
