完善探矿权法律法规之见解

The insights of improving the laws and regulations of mineral rights

2006年在国务院"建立健全地质勘查法规体系,严格依法行政,依法维护地质工作秩序,为地质调查和矿产资源勘查提供良好的工作环境"的要求下,我国的地质找矿工作快速发展。但由于我国的《矿产资源法》是1986年颁布的,虽然1996年对其进行了修改完善,但至今也有16年了,致使该法在很大程度上落后于矿产资源管理体制改革和发展的需要。此外,由于勘探权市场的从无到有至快速发展,要求更加完备的探矿权法律法规跟进,为其提供重要的法律法规支撑。文章从探矿权立法的原则入手,对我国的探矿权立法提出若干建议。

Since State Council issued the Mineral Resource Law in 2006, especially on the statement like ＂ establish and perfect the geological exploration regulations system, strict administration by the law, maintain the order of geological work in accordance with law, and provide a good working environment for geological survey and mineral resources exploration＂ 2006, Chinese geological and ex- ploration for discovering minerals resources has developed quickly. Up to now, it has gone through 16 years. Although the Mineral Re- source Law had been amended in 1996, the Law has largely lag the need of structural reform and development for mineral resources management. In addition, the mineral right market has increasing from zero in the past, therefore, it requires the complete laws and regulations of mineral right to follow in order to provide the concrete support for the mineral right market system. This paper proposes some devices about the mineral resource legislation from the principles for the mineral right legislation.
