摘要
随着我国城市化的发展,城市化范围向农村扩张,农村集体土地上房屋拆迁在司法实践中存在法律适用的困境,法律依据缺乏可操作性,房屋拆迁主体、拆迁程序及拆迁补偿标准的法律规定不完善,而且已有的相关立法层次较低。有必要完善农村集体土地上房屋拆迁及补偿的法律,明确规定拆迁补偿项目和房屋价值评估,完善补偿及安置方式,严格拆迁及补偿管理,确立"先补偿、后搬迁"的原则,统一规定两种形式的集体土地上房屋拆迁及补偿。
Along with the development of China's urbanization, the urbanization range expands to me rural areas, taw application of rural housing dismantlement in the judicial practice is in the plight that the legal basis lacks the operability, the laws about the subjects, the procedure and the compensation standards of housing dismantlement are imperfect and in a lower level. It is necessary to improve the laws of the rural collective land for housing dismantlement and compensation, clearly defining the compensation range and the assessment on the house value, perfecting compensation and resettlement way, strengthening management of dismantlement and compensation, establishing the principle of "first compensation and then removal", and regulating provisions concerning the two forms of housing dismantlement and compensation of rural collective land.
