欧盟食品添加剂使用的法律规制及其启示

EU Legal Regulation for Food Additives Use and Its Enlightenment

欧盟有一套完善的食品添加剂使用的法律规制体系,包括食品安全综合性立法和对食品添加剂的专项立法,构成了一种典型的"伞状"体系。欧盟立法以肯定的形式列出可使用的食品添加剂清单,依其立法,只有经批准列入食品添加剂清单才可使用添加剂,并且必须严格遵照使用标准和监管制度。我国规制食品添加剂使用的立法存在着法律体系分散、标签制度欠缺、使用标准不统一、食品添加剂清单不科学等问题。我国可以在借鉴欧盟经验的基础上对分散的立法进行整合,对使用标准进行完善,统一监管部门职责,健全食品安全保障体系。

This paper aims at seeking enlightenment of food additive legislation in China based on the exploration of EU food ad- ditives legal regulation. With a generalization of the system of EU food additives legal regulation and detailed analysis of its spe- cific system designs,we conclude that EU legal system of food additives use is systematic, timely updated, precautionary, scien- tific and strict. Then turning to Chinese legislative practice,the authors sum up the existing problems in the present food addi- tives law and propose measures for improvement.
