中国古代职务过失犯罪研究

A Study of Duty Negligence Crime in Ancient Times of China

在中国原始社会末期 ,对部落管理人员过失行为的惩处 ,是中国古代职务过失犯罪的萌芽 ;进入奴隶社会 ,在“政典”和“礼”中出现的职务过失犯罪的规定 ,是中国古代职务过失犯罪立法的开端 ;在封建社会 ,随着历代“吏治”思想的发育 ,促进了职务过失犯罪立法的发展 ,有了一般界定 ,确立了责任追究制度。这标志着中国古代职务过失犯罪的立法经过不断演变 。

This paper holds that the seeds of duty negligence crime in ancient times of China are the punishment of tribal administrative personnel for their duty negligence at the end of primitive.the beginning of duty negligence crime legislation in ancient times of China are the stipulations of duty negligence crime in the decree and etiquette in slave society.In the feudal society,the growth of official system promotes the duty negligence crime legislation,general limits have been founded.Investigating responsibility system has been determinded.All these marks the evolution and maturity of duty negligence crime legislation in the ancient times of China.
