南海涉外行政执法的对策研究

Strategy for Foreign-Related Administrative Law’s Enforcement of the South China Sea

南海对我国具有重要的战略价值,为了维护我国南海权益、彰显南海主权,必须加强南海涉外行政执法力度。但受到目前海洋行政执法体制等因素的制约,我国南海涉外行政执法存在着诸多的缺陷。为了克服这些不足,需要从涉海性与涉外性两个角度出发,结合国际法和国内法的规定,从执法主体、执法权力以及执法程序等方面完善我国南海涉外行政执法制度。

The South China Sea has great tactic value for China.In order to safeguard and demonstrate its interests and sovereignty,we must reinforce the strength of foreign-related administrative enforcement of law.However,there are several defects in the system of ocean administrative enforcement of law right.To surmount those defects,we need combine the international law provisions and domestic law provisions from the perspective of sea-related and foreign-related,and try to perfect foreign-related administrative enforcement of the South China Sea system via perfecting its enforcement subject,power and procedure.
