摘要
我国痕迹物证收集中存在的主要问题有收集痕迹物证的程序违法、对痕迹物证的收集不及时导致有的痕迹物证时过境迁难以弥补、对痕迹物证的证明标准把握不好而忽视证据质和量的辩证关系等。要完善我国痕迹物证收集工作,应该严格按照痕迹物证收集程序开展收集活动;痕迹物证的收集要及时准确、客观全面;及时更新痕迹物证收集活动观念并树立坚强的证据意识;强化痕迹物证鉴定结论收集和运用意识。
Main problems in lection which causes irreversible collecting trace evidence include violation of legal due process, lacked coldamage to evidence, lack of standard of valid evidence testification which leads to ignorance of dialectical relation between quality and quantity, and etc.. To improve the work of trace evidence collection in China, the following aspects shall be emphasized： Collection work shall be carried out in strict accordance with due process; Trace evidence shall be collected throughly in time with accuracy; The awareness of trace evidence collection shall be updated in time and strengthened; The awareness of recording and applying the conclusion of trace evidence analysis shall be enhanced.
