摘要
在检索和分析了2012年出版的法学关键刊物以及其他相关延伸刊物中发表的法理学研究成果后,本文把这些研究成果区分为基础理论和现实问题两部分加以综述。大致勾勒出本年度法理学前沿的轮廓:1.学术主体意识增强,学者们集体尝试建构中国式法理学,并正在成为世界法理学舞台上的生产者;2.对于中国立法、司法、执法等深层问题的解决方案何去何从,学术争鸣气氛浓郁;3.基础理论研究向纵深拓展;4.精准聚焦现实问题,回应了中国社会转型关键期呈现的各种法律理论问题和现实问题。
This paper made a detailed review of the research of jurisprudence in China in 2012. These researches were divided into two parts, discussions on theoretical problems and viewpoints on practical problems. The research on jurisprudence in China in 2012 demonstrates the following distinguishing features： improvement in independence of academic consciousness; revival of atmosphere of dispute and debate between scholars; enlarging and deepening of the field of theoretical research; and focusing on practical problems.
