职务犯罪案件批捕权之现状及应对措施

Current Situation and Countermeasure of Arrest Approval Power of Post Crime

职务犯罪案件批捕权由上一级检察机关决定,对加强办理职务犯罪案件的监督制约,确保检察权特别是职务犯罪侦查权的依法正确行使,提高职务犯罪案件办案质量具有积极作用。但也存在一些问题,应对的措施主要是:调整自侦部门侦查办案模式;建立自侦案件的报捕证据标准并探索确立职务犯罪案件附条件逮捕制度;规范自侦部门与侦监部门的配合联动机制。

Arrest approval power of post crime is determined by the procuratorial organs at the higher level,which has a positive effect on strengthening the supervision and restriction in handling post crime cases,ensure the proper exercise of the prosecutorial power especially the investigative powers of post crime in accordance with the law,and improving the quality of handling post criminal cases.However,there are still some problems,so the article provides some countermeasures： 1.regulating the working mode of self-investigation organs;2.establishing the standard of evidence for arrest of prosecutor-investigated cases and exploring the establishment of conditional arrest system of post crime;3.standardizing the cooperation and linkage mechanism between self-investigation organs and investigation-supervision departments.
