工程结算中现场签证风险的应对

Study on the Risk Response of Site Visa in Engineering Settlement

由于承发包双方在工程施工过程中,对现场签证重视不够;也由于双方利益的博弈,对项目建设中的矛盾存在不一致的处理方式,极易导致工程结算纠纷和现场签证风险。应通过完善法制建设,规范承发包双方在现场签证中的行为,加强双方互谅,调动其积极性,来达到风险控制的目的。

The risk of dispute comes from two major reasons. On one hand, the two parties of the contract don＇t attach great importance to site visa during the construction; on the other hand, considering their own benefits, each party of the contract uses different ways to deal with their disputes at different stage of the construction. In order to control all the risks, we should improve relevant laws and regulations, regulate the behaviors of employer and contractor in site visa, enhance the mutual understandings between the two parties of the contract and motivate the enthusiasm of good cooperation.
