摘要
部分学者为了废除死刑,使用理论论证和举国外的实证研究证明死刑不具有有效的威慑力,笔者在对这些学者的证明一一反驳之后,利用法经济学分析举证责任,解决"死刑是否具有有效的威慑力"这一难题。
In order to abolish the death penalty,Some scholars have shown that the death penalty does not have an effective deterrent by using theoretical arguments and cite foreign empirical studies,I use the burden of proof of the law and economics analysis to solve the problem of 'whether the death penalty has a valid deterrent '.
