论我国抵押物转让制度的重构

Study On Reconstruction of China’s Collateral Transfer System

传统大陆法系各国民法典普遍赋予抵押权以追及效力,在此前提下允许抵押物自由转让。我国限制抵押物自由转让的立法规定既未虑及受让人的利益,也不符合物权法物尽其用之法旨。为此,我国立法应当允许抵押物自由转让,赋予抵押权人追及权、受让人涤除权,以完善该制度。

The civil codes of all countries in the traditional continental law system generally grant mortgage the force of recourse, and in this premise they allow the flee transfer of collateral. China＇s legislative provisions of restrictions on free transfer of collateral neither take into account of the interests of the assignee, nor conform to the legal purpose of getting the most use out of any given object. Therefore, China＇s legislation should allow the free transfer of collateral, and grant mortgagee the recourse right and assignee the elimination right so as to improve the system.
