摘要
《资政院议事细则》在晚清时期的出台及其实际运作,催生了近代中国议事之学(简称"议学"),孙文在民国前期编著的《民权初步》则是"议学"发展的高峰。《资政院议事细则》在实践过程中暴露出来的学理问题,在《民权初步》中都得到了较好地解决。但民国时期政治的专制独裁色彩,导致《民权初步》不能成其为"民权初步","议学"本身也沦为无足重轻的"小道"。批判并清除形形色色的专制土壤,尽量弥合"知"、"行"之间的断裂,防止各类独裁者利用像"议学"这类先进外衣为专制独断背书,既是议学走向成熟的前提,也是发达民权的必经之路。
The proclaiming and operating of the Procedure Rules of Zizhengyuan(Zizhengyuan yishi xize) witnessed the knowledge on parliamentary law coming into being in modern China,and Preliminary Civil Rights(Minquan chubu),compiled by Sun Yat-sen,is the symbol of summit of the knowledge on parliamentary law.The theoretical problems that were exposed during Procedure Rules of Zizhengyuan's operation,were resolved bitterly by Preliminary Civil Rights.It is highly regrettable that the knowledge on parliamentary law is so insignificant because of dictatorship during the period of Republic of China.All in all,criticizing and cleaning out dictatorship,and remedying the fracture between knowledge and action,are the presupposition on developing the knowledge on parliamentary law and the only way which must be passed on how to achieve the civil right.
