关于《招标投标法》的探讨

文章主要研究现行《招标投标法》与其实施前的相关地方法规的重大变革之处，论述《招标投标法》的强制招标制度，招标投标程序和方式，潜在投标人法律地位的保护，不一定编制标底的规定，招标人保守投标人商业秘密的义务，投标人不得以低于成本的报价竞标，以及中标人的确定原则等内容。

This paper mainly researchs on the significant change between the current 'Bidding law' and the relative endemic regulations before the former was promulgated, at the same time, it expounds the compulsory bidding system, the bidding procedure and pattern, the protect to potential bidder's legal position, the definition uncertainly working out pre-tender, the responsibility keeping the bidder's confidential and the decisional principle for final bidder, etc..
