法治国家、法治政府、法治社会一体建设的标准问题研究———兼论我国法制良善化、精细化发展的时代任务

Standard of Integration Construction of State Ruled by Law, Government Ruled by Law and Society Ruled by Law ——Also on the Era Task of Better and More Detailed Development of China′s Legal System

在建设法治国家、法治政府、法治社会的大背景下,法治一体建设的路向和课题值得认真研究。由于复杂历史原因形成了还不完善的我国现行法制体系,如何实现法制的良善化、精细化已成为深入转型发展时期的时代任务。在全球法治发展背景下出现的世界正义项目和法治指数运动,给予人们许多启发。从法治建设诸项标准的理据分析和实践探索中可以看出,改革开放30多年来我们既有创新成果和成功经验,也有认识误区和负面教训,值得认真总结、坚定方向、改善前行。笔者提出的法治一体建设的评价标准之基本构想,旨在为深入研究解决法治一体建设标准提供参考思路。

In the background of society ruled by law, government ruled by law and society ruled by law, the direction and topic of building a legal integration law system is worthy of careful study. Due to the complex historical reasons , the current formation of legal system in China is far from perfect. So how to achieve a better and more detailed legal system has become the task of the transformation period. In the context of development of rule of law, the Justice Project and the Rule of Law Index Movement have given people more inspiration , which is also worth being re-searched. During the 30 years of reform and opening up, as it can be seen from the theoretical analyses and practice of the standards of legal system construction, we had both innovative and successful experience, as well as misunderstandings and lessons. We have to carefully summarize , insist on the right direction and make improvement. In this paper, the author come up with the basic idea of the integration construction of law system to provide reference for in-depth study.
