论我国公务员依法行政能力的构成与提升

On Composition and Promotion of the Ability of Law-Based Administration of Civil Servants in China

"依法行政"由紧密联系的三个逻辑环节所构成:"法"的存在是前提;"行政"是指过程及其结果;"依"则是指由法达至行政价值目标过程中所使用的方法和所遵循的路径。与此相关联,公务员应当具备较高的学法能力、对法的理解与解释能力、用法解决涉法性问题的实践性能力等。然而,由于受到外在与内在各种因素的影响,我国公务员依法行政能力的总体水平依然较低。为更好地实现行政价值目标,就必须努力提升公务员依法行政的能力。

Howsoever, as a result of the impact of diversified subjective factors and objective factors, the general level of the ability of law -based administration of Chinese civil servants are still low. In order to achieve the goal of administrative value better, the ability of law - based administration of Chinese civil servants must be hardly promoted.
