摘要
计划经济体制下,权力本位理念取得主导地位,导致我国土地制度的异化,造成集体"产权残缺"、"地权歧视"等诸多问题。市场经济体制下,应本着权利本位理念重构集体建设用地使用制度,赋予集体建设用地使用权人充分的土地权利,实现集体建设用地使用权与国有建设用地使用权的平等,使集体建设用地和国有建设用地能在统一的市场内进行优化配置,并通过土地规划、土地税收、农地补偿等制度实现公私利益和不同用途、不同区域间土地利益平衡。
Under the planned economy, power standard had achieved a dominant position, which led to the alienation and a collective "incomplete Property Rights", "discrimination" land rights and many other issues. Under the market economic system, we should use the concept of rights - based to reconstruct the system of collective construction land, to give the collective con- struction land user full land rights, to realize the equality between collective construction land use right and state -owned construction land use right, which can optimized configure the collective construction land and state -owned construction land within a unified market, and through land use planning, land taxation, agricultural land compensation system to achieve the balance of pub-lic and private interests with the land interests of different purposes and different regions.
