构建我国婚内侵权责任制度的若干思考——以婚内人身权损害为视角

Some Thoughts on the Construction of the Liability System of Tortious Acts in Marriage in China——From the Perspective of Personal Rights Damage in Marriage

我国现行离婚损害赔偿制度存在诸多不足,婚内侵权又缺乏民事救济,大量的婚内侵权行为无法得到制裁,因此出台婚内侵权责任制度尤为必要。夫妻独立人格意识的增强、夫妻个人财产数量的增加为构建婚内侵权责任制度奠定了基础。可以重点从完善现行的夫妻约定财产制、扩大适用非常财产制的重大事由两个方面,为构建我国的婚内侵权制度排除障碍。

There still exist some deficiencies in Chinese present divorce damage compensation system. Tortious acts in marriage lacks civil remedy and lots of tortious acts in marriage didn＇t receive sanctions. So it is quite necessary to implement the liability system in marriage. That the enforcement of couple＇s independent personal consciousness, the increasing of the couple＇s personal property lays the foundation to the construction of the liability systems of tortious acts in marriage. It is feasible to remove the barriers of constructing the liability systems of tortious acts in marriage mainly from two aspects, i. e. perfecting the present couple＇s contractual property system and enlarging the important reasons applied to the special property regulations.
