地方法院司法能动的社会效果研究——以劳动合同法的实施为例

Social Effects of Judicial Activism on Local Level——Based on the implementation of the labor contract law

劳动争议案件的大幅增加给各级法院特别是基层法院带来巨大的压力,这种压力不仅来源于工作量的增加,更来源于维护社会稳定的大局观。面对巨大的压力,在"能动司法"的理念指导下,基层法院建立了劳动争议司法提前介入制度,中、高级法院纷纷制定指导意见以回应金融危机对我国劳动关系的冲击。各级法院的能动措施对解决劳动争议、缓解企业在金融危机中的压力确实起到一定的作用,但是对其导致的消极后果和溢出效应应当保持足够的警惕。由于法律相对社会情境的滞后性,法院确有必要以积极和能动的方式回应社会需求,但是无论如何,法院都要以"司法"的方式,而不是行政或立法的方式来回应不断变化的社会情境。

Significant increase of labor disputes puts great pressure on the courts at all levels, especially grass - roots courts, and such pressure comes from not only the increase in workload, more from maintaining social stability. In response to the impact of the financial crisis on China~ labor relations, grass - roots courts have established judicial prior intervention system in labor dispute, and senior courts have set the guidance rules. The active measures of the courts at all levels do play a role in solving the labor disputes, alleviating the pressure of the enterprise in the financial crisis, but their negative consequences and spillover effects should be focused. Because the law generally lags behind social situation, it is necessary for the court to respond to the needs of society with positive and active way,but in any case, the court should take ＂judicial＂ means, instead of the administrative or legislative way, to respond to the changing social situation.
