摘要
雇佣劳动关系中,劳动者的"劳动"是从属于雇主的非自由行为,而劳动者争取劳动条件的"行动"则是实现自身利益的自主行为,两者具有不同的行为特征,很难凭借抽象法学概念将其统一起来而需要借助"规定功能法概念"的建构方法:以"关系正义"理念评价雇佣劳动关系秩序时,劳动者行为的规范纲领可以确定为"公平地对待劳动者",并发展出"对等决定劳动条件原则"与"保护劳动者人权原则"。前者可以通过劳动者的"行动"规则得以具体化,而后者则可以通过对劳动者"体面劳动"权益之强制保障规则来实现。由此勾勒出劳动法学中行为理论与制度体系之间的关联方式及其与劳动者权利之间错落有致的搭配,形成内在和谐与外部统一的劳动者行为规范体系。
In a subordinate position in the employment relationship, the labourer beheviour forms a demarcation in labour and action, that cannot be reasonable unifed to a behaviour system in labor law. So, the conception of it could he constructed as a functional conception. The hart of labourer beheviour legislation is how to deal justly with labourer. Based on it, basic principles of behaviour system in labor law will outline the thread of labourer behaviour concept and the law practice; also explain functions of law system of the concept of labourer behaviour perfectly.
