The International Comity Doctrine of Netherlands

摘要 "国际礼让说"是17世纪荷兰学者Huber所创立的法律适用理论,其不仅在欧洲实现了法律适用理论变革,也对英国和美国国际私法的发展产生了深远影响。然而,目前我们对该学说存在一些误读。为了改变这种状况,首先再现"国际礼让说"产生的经济和法律背景;继而对该学说的内容进行分析研究,阐明"国际礼让说"包含的四个原则,揭示该学说采用"礼让"形式推行"既得权"的本质;最后,对该学说进行综合评论。 The international comity doctrine was constructed by Dutch scholar Huber in seventeenth century. This doctrine not only had realized the great change in international private theory in Europe, but also has had a profound influence on the development of international private law in the United Kingdom and the United States. However, there is some misunderstanding on the doctrine now. In order to change this situation, this paper firstly reviews the economic and legal background of the doctrine, and analyses the contents of the doctrine, and stated the four principles contained in it, and reveals the nature of this doctrine is vested rights with the form of ＂ comity＂. Finally, this paper conducts a comprehensive evaluation on this doctrine.
