检察机关参与环境公益诉讼的实证分析

Empirical Analysis on the Environmental Public Interest Actions Involved the Procuratorial Organs

近年来,随着现代化进程的深入推进,我国的环境污染与破坏问题日益显现,不仅严重侵害了公众的身体健康和财产安全,也给生态环境本身造成难以回转的损害。为维护环境公益,一些地方检察机关根据当地的实际,积极参与环境公益诉讼,开展了一系列有效的实践和探索,取得了一定的成效。以实证考察的方法,对检察机关参与环境公益诉讼的几个实务问题进行分析探讨,期望能以此推进地方环境公益诉讼制度的建立和发展。

In recent years, with the promoting in -depth social modernization process, the environment pollution and damage in our country are increasing, which not only serious violated the people＇ s health and the safety of the properties, but also cause irrevocable damage for the environment. For keep the environmental public interest, depending on the situation, some local procuratorial organs has taken an active part in environmental public interest actions and developed a serious of effective practices and search. As a result, it obtained the good achievement. Through the way of substantial investigation, this paper analyzed some issues in practice on environmental public interest actions, which involved the procuratorial organs, and hope it can actively push furward the construction of the local environmental public interest actions systems.
