The Predicament of the Property Rights Management of China's Private Colleges and Universities and Its Solution

民办高校产权管理是对民办高校产权各项权益进行产权界定、产权配置、产权监管、产权运作等一系列管理行为的系统活动,存在一些有待厘清的问题:法人产权不完整,合理回报缺乏规范办法;内部治理结构不完善,举办者管理能力欠缺;教育行政部门监管职能分散,资产财务制度不完善;筹资渠道不畅,产权运作发展滞后。相应的解决策略是:依法落实法人产权,完善合理回报政策;实行多元主体共同治理,发挥不同主体的产权管理效能;建立民办高校专门监管机构,规范资产财务监管;拓展民办高校筹融资方式,健全产权转让和分类退出机制。

Property rights management of private institutions of higher learning is a series of management activities including the definition,the allocation,the regulation and the operation of property rights.Several issues that still remain elusive and require further clarification are as follows： imperfection of the school corporate property rights and lack of a normative approach to address reasonable return on educational investment;uneven overall quality of organizers and imperfection of internal governance structure;the incompetence of the administrative departments of education on finance and asset regulation of private schools;the impeded fund-raising channels and the underdevelopment of property rights operation.The corresponding solutions to the above problems include implementing the corporate property rights of private colleges and universities in accordance with the law,improving policies on reasonable return,conducting co-management by multi-interest subjects,giving full play to the different subjects’ property rights management efficiency,setting up governmental agencies specialized in private education management,regulating the assets of financial regulation and the property rights operation mechanism,encouraging multi-form fund-raising and improving the mechanism of property rights transference and classified withdrawal.
