A Conceptualization of Fine Penalty Enforcement and Operating Mechanism of Inspection and Supervision

在文献回顾基础上,分析了产生罚金刑执行和监督困境的原因,认为:缺乏规范性、统一性是罚金刑执行难的最大缺陷,此外,执行人员缺少罚金刑强制执行意识和监督意识、考核体制、罚金刑的特殊性,也是产生罚金刑执行和监督困境的原因。论述了在当前体制和法治环境下,罚金刑的执行及检察监督运行机制之构想的可行性。

By conducting literature reviews, the author makes analysis of reasons for the predicament in enforcing and supervising fine penalty. It is be-lieved that the biggest obstacle in enforcing fine penalty lies in the lack of stand-ard and unification. Besides, the executor＇s lack of sense of enforcing and super-vising, the evaluative system, particularity of the fine penalty are all to blame. The thesis also discusses the feasibility of conceptualizing fine penalty enforce-ment and operating mechanism of supervision under current legal systems.
