里耶秦简“隶妾居赀”问题研究

里耶秦简中出现了"隶妾居赀"一词,它是刑徒"隶妾"的一种刑罚类型,让"隶妾"去服"居赀"的劳役。"居赀"虽然是有偿的短期劳作,但"居赀"者是服"城旦舂"劳役的,其劳动强度要大于"隶臣妾"。"隶妾居赀"就是刑徒"隶妾"在服刑期间又犯了破坏或丢失公物等经济犯罪,自身又没有资产偿还,就以"居赀"服劳役的形式偿还。"隶妾居赀"也是跟"居赀"者一样被居于城旦舂服刑,这种刑罚是重于"隶妾"但轻于"城旦舂"的。
