The Military Judicial System Reform in the Perspective of Enhancing Military Judicial Capacity

提高司法能力是我国司法体制改革的重要目标,因此,是否有助于提高军事司法能力为我国军事司法体制改革提供了一个崭新的视角。从提高军事司法能力的角度来看,我国的军事司法体制改革需要:调整军事司法资源配置,使军事司法资源配置最优化;提高军事司法人员的素质,建立稳定的、高度职业化的军事司法队伍;增强军事司法机构的独立性,减少军事行政机关对军事司法机关办理具体案件的干预。

Enhancing judicial capacity is an important goal for the judicial system reform in China. Therefore, whether it is favorable for enhancing military judicial capacity is a new perspective for the military judicial system reform in China. In the view of enhancing military judicial capacity, what we need to do to reform the military judicial system are as follows ： optimizing the allocation of military judicial resources; improving the quality of the military judicial staff, making the military judicial positions be stable and highly professional employment; strengthening the independence of military judicial organs, reducing the intervening of military administrative organs towards the concrete work of military judicial organs.
