物权法定原则在成本控制和交易自由的双重压力下,已到了不得不检讨的时候。但重新认识物权法定原则,还需要重视物权法定本身的包容性。首先,维护物权法定关乎物权结构原则的稳定性;其次,物权体系并非一成不变,财产权系统允许续造,形成了新的法定物权;另外,就我国的实际情况而言,这一原则写入物权法有其价值考量,而在物权类型法定的同时也要注重其与公示制度的配合。
