论DSB裁决执行审查程序适用中的法律问题

摘要 WTO/DSU第21.5条是DSB裁决或建议执行措施的审查程序,该程序使DSB裁决的有效执行有了制度保障。然而,由于该程序条文上规定得太原则,太笼统,在适用中暴露出许多问题:没有明确规定提起执行审查程序的主题资格、没有界定专家组的职责范围、该程序和第22条报复程序的适用顺序规定得模糊不清等等。针对这些问题,对一些应对措施予以研究。
