我国环境公众参与制度之探析

The Analysis of the Chinese Public Participation in Environmental System

公众参与制度是我国环境保护法中的一项重要制度,其也是公众参与环境管理和解决环境问题的重要途径。但由于目前我国环境保护法关于公众参与的实体方面和程序方面的法律规定不尽完善,致使公众参与制度在现实中不能发挥应有的作用。通过探讨我国环境公众参与制度在实体和程序方面的不足并加以完善,进而实现公众参与制度在现实生活中应有的效能。

The Public Participation System is an important system of the Environmental Protection Law in our country, which is also an important way on public participation in environmental management and solving environmental problems. However, the Public Participation System can not play i^s proper role in reality as the current legal regulations about entities and procedures of public participation are not perfect in Chinese Environmental Protection Law. Through the discussion on the deficiencies in both entity and procedure of the Environmental Public Participation System, we can try to improve it, and then realize its proper efficiency in real life.
