Judicial Breakthrough of "Drunk Driving into the Punishment"——A Case Studv of the X court

随着我国机动车数量的日趋增多,因饮酒引发的交通事故数量不断攀升,严重危害了公共安全和社会秩序。"醉驾入刑"是我国最重要的刑事立法,有效地遏制了因醉驾带来的对生命的戕害和对公共安全的破坏。本文针对司法实务中存在的主刑差距较大、缓刑适用"一刀切"、罚金刑过于集中和随意等困境,提出了具体的完善措施,以期实现"醉驾入刑"的司法意义。

As the number of vehicles in China is increasing day by day, the number of traffic accidents caused by alcohol consumption continues to rise, seriously endangering public security and social order. ＂Drunk driving into the punishment＂ is Chinas most important criminal legislation, to effectively curb its damage to life and public security. This paper put for- ward specific measures of improvement to realize judicial significance of ＂drunk driving into the punishment＂ according to ex- isting gap between the punishment in the judicial practice, uniform probation, concentrated fine punishment and random punishment.
