水务公私合作中的政企权责均衡分析

Analysis of the equilibrium between governments and enterprises′ rights and responsibilities in PPP water service

公私合作是提高水务服务水平和效率的重要途径。我国水务公私合作发展迅速,模式多样,但由于政府和企业之间的权责不均衡带来了一系列问题。为了深化水务改革,促进水务科学发展,从政企关系出发,探讨了政企权责划分的要求,分析了BOT、TOT和委托运营等3种常见的水务公私合作模式中政企权责划分的现状、非均衡表现及其原因,进而提出优化政府水务服务权责的纵向划分;规范政府行为,在产权分离的基础上强化政府监管;逐步形成优质优价的行业竞争机制等建议。

PPP（Public-Private-Partnerships） is an important way to improve the level and efficiency of water service. In China, it develops rapidly and the pattern grows diversified. However, it brings a series of problems due to the unbalanced rights and respon- sibilities between governments and enterprises. In order to deepen the water service reform and to promote its scientific development, this paper, which is on the basis of relationship between governments and enterprises, tends to discuss the requirements of division in powers and duties, and analyze the division＇s status quo and unbalanced performance with its reasons by choosing three common modes of PPP such as BOT, TOT and Operation ＆ Maintenance Contract. Accordingly it is proposed to optimize the longitudinal di- vision of government＇s rights and responsibilities in water service, regulate government＇s behavior, strengthening government regula- tion based on the separation of property rights, and gradually forming an industry competition mechanism with high quality and low price.
