民事执行检察监督的范围与程序研究

新《民事诉讼法》明确规定了民事执行的检察监督权,这是对民事执行检察监督合理性的肯定。在此基础上,本文进一步探讨了民事执行检察监督的范围和程序问题。民事执行检察监督的范围应包括执行实施权和执行裁判权的整个行使过程;检察监督程序应主要依当事人申请而启动,由同级检察院进行监督;根据执行中的不同情况,检察监督也应采取不同的具体方式。

The new Code of Civil Procedure clearly defines the power of prosecutorial supervision of the civilian implementation.
