摘要
伴随《高等学校章程制定暂行办法》的颁布实施,各地各高校全面启动了章程制定或修订工作,但在章程的制定或修订中还存在要素不全、边界不清等问题,影响章程建设工作的推进。文章在对大学章程要素进行辨析的基础上,选取"办学宗旨"、"办学规模"、"学科门类的设置"、"教育形式"、"内部管理体制"、"经费来源、财务和财务制度"、"举办者与学校之间的权利义务"等七大要素,对其边界进行研究。
With the promulgation and implementation of The Interim Measures of Statutes Establish- ment in Higher Education Institutions, colleges and universities have started the formulation or revi- sion of the articles of statutes. But some factors such as insufficient element and unclear boundary have influenced the promotion of statutes construction. Based on the identification of key elements of university statutes, the boundary of university statutes is researched in view of seven key elements in- cluding mission, scale, subject setting, education pattern, internal management system, source of funds and financial and accounting system, and rights and obligations between organizers and university.
