摘要
苗族解决无证据纠纷神判方式源于苗族人对鬼神的敬畏以及对自然和祖先的崇拜。捞油锅、踩铧犁、喝鸡血等是苗族神判的主要方式。虽苗族神判方式愚昧落后且与国家法存在冲突,但其有利于解决苗族内部无证据纠纷,对苗族成员有警示作用及在一定程度上可弥补国家法之不足。在今日苗族村寨,神判已不再是解决无证据纠纷的主要方式,但受文化惯性影响,不仅神明裁判观念仍然存在,有的神判方式在解决无证据纠纷中仍具有重要威慑作用。对苗族神判进行客观分析与理性批判,对我国苗族地区构建和谐社会具有重要现实意义。
The ordeal that the Hmong used to solve dispute without evidence from the Hmong people fear of the gods and worship of the nature and ancestors. Fishing of the pan, step on the plow, drink chicken blood, being the main form of Hmong ordeal. Procedural justice, without external force to ensure it implementation, the ruling standard unscientific and strong religious is the important feature of the Hmong ordeal. Although the Hmong ordeal ignorance and backwardness, there is a conflict with the national law, but to a certain extent, compensate for the inadequacy of state law. In today's Hmong village, although the ordeal is no longer the main way, but by cultural inertia effects, not only the ordeal concept is still there, it sometimes still is used to solve dispute without evidence. Objective analysis and rational criticism the Hmong ordeal, has important significance in building harmonious society of the Hmong areas.
