论我国遗产管理制度的构建与完善

On Establishing and Improving the Heritage Management System of China

为妥善解决遗产继承及遗产上的债权债务问题,必须构建与完善我国遗产管理制度。确立完善的遗产管理制度是修订《继承法》的一项重要任务。构建与完善我国遗产管理制度必须明确遗产管理人法律地位、构建遗产管理人确立或选任制度、明确遗产管理人职责、构建与完善遗产管理人责任制度以及遗产管理监督管理制度,此外还需要有关于临时遗产管理人的规定。

Heritage management system should be established and perfected in order to properly solve the problems of inheritance and creditor＇s rights and debts on heritage, which is one of the most important tasks in revising inheritance law in China. To achieve the goal, we must clarify the legal status of administrators of the estate, establish the system of choosing and appointing administrators, clear and definite administrators＇ duties and responsibilities, establish and improve administrators＇ responsibility system and supervision system of heritage management. In addition, we should set up rules about temporary administrators.
