论旅游合同违约之精神损害赔偿

On Mental Injury Compensation in Breach of Travel Contract

因旅行社违约造成旅游者精神损害问题日益突出,但目前我国立法上、法学理论界、司法实践中大多不认可违约之诉的精神损害赔偿请求。旅游合同违约精神损害赔偿具有法理上的价值。借鉴域外法关于违约精神损害赔偿的规定,我国可将旅游合同违约精神损害赔偿纳入合同法保护领域,并在立法上明确该类精神损害赔偿的构成要件、适用情形及赔偿标准。

The problems that the travel agency breaks the contract and brings spirit damage to the tourists have become increasingly prominent. But in most cases, the current legislation of our country does not ap- prove the request of spirit damage compensation, either from the perspective of the legal theory or the judicial practice. It is suggested that the country introduce the spirit damage compensation in breach of travel contract into the protection of contract law, and clear out the spirit damage compensation elements, applying conditions and compensating standards in legislation.
