村委会选举中的贿选问题及其规制措施的思考

我国自1982年《宪法》确立了村民委员会的法律地位算起,以村民自治为主要形式的中国农村基层民主已经走过了30个年头。这是我国社会主义基层民主建设事业的巨大进步,推动着我国整个社会主义民主政治的良性发展。自实行村民自治以来,虽然赋予了广大村民实现"自治"的权利,但是在农村选举实践中,这一自治权利并没有得到良好的发挥,反而在选民与候选人之间产生了"权钱交易"的现象,农村选举中出现了贿选。本文对村委会选举中贿选现象的产生根源以及贿选现象的防范和遏制进行研究,以期对这种不正之风有所规制,从而保障我国农村基层民主建设的顺利进行,促进农村社会的稳定与发展。

The villagers＇ autonomy has been the main form of rural grassroots democracy in China rural areas for more than thirty years since the legal status of villagers＇ autonomy was established by the Constitution in 1982. This is the progress of our socialist grassroots democracy pushing the giant development of our socialist democracy. Since the system of villagers＇ autonomy was implemented, although it entitled the villagers to achieve their rights freely, their autonomous rights cannot be achieved in practice. In contrast, the phenomenon of fraud between voters and candidates during village committee elections can be found time to time. Therefore, in order to guarantee the smooth progress of our rural grassroots democracy and increase the rural social stability and development, the authors focus on the fundamental reasons of bribery in the election and then formulate the measures of precaution and inhibition on bribery in the election.
