作为古老的自我保护与私力救济的重要手段,私人刑事调查一直广泛存在。但在当前中国,私人刑事调查暴露出了诸多弊端。从私家侦探刑事调查、律师私下刑事调查和其他私主体刑事调查三方面出发,对现今我国私人刑事调查存在的主要弊端展开分析,认为弊端的消解可从设立专门的私人刑事调查法律和对私家侦探实施特殊监管两步骤着手。

As an ancient yet important method of self-protection and private remedy, private criminal investigation has long and extensively existed. But nowadays in China, the private criminal investigation exposed a lot of defects. From the perspectives of criminal investigation from private detectives, lawyers and other private subjects, we analyze its main defects, and reach the conclusion that the defects can be resolved by the legislation.of private criminal investigation, as well as special regulation towards private detectives.
