摘要
小产权房是我国城乡二元土地所有制度下伴随着城市化快速发展和商品房价格快速上涨过程中出现的。小产权房建设虽然违反了我国现行农村土地利用相关法律法规,但它的存在在某种程度有一定的现实合理性。小产权房涉及国家、农村集体、农村个人以及小产权房购买者等多方利益,如何妥善处理小产权房问题,成为社会各界关注的焦点,也成为各级政府亟待解决的一个难题。
The small property right room appears in the binary system of urban and rural land ownership with the rapid development of city and rapid rising of commercial housing prices. Although construction of small property right room violates our current rural land use laws and regulations, it exists with some realistic rationality.The small property right room touches multiple interests of nation, rural collective, rural individual and the buyers of mall property fight room. How to solve the problem of small property right room properly, has become the focus of attention of the community, and has also become a difficult problem for governments at all levels to solve.
