政府信息主动公开的法定载体及其法治完善

政府公报制度的建立与完善具有促进政府信息公开、促进公众参与行政决策、确保法规文件的规范效力等功能。我国《政府信息公开条例》存在没有明确不同政府信息公告载体的法律地位和配套法规不足等漏洞。美国《联邦公报》的制度化和体系化,促使政府公报制度成为现代政府信息公开制度的重要组成。借鉴美国《联邦公报》推动我国政府信息主动公开载体的法治化,一是应当在立法中明确公民的知情权;二是建议制定专门的政府公报法;三是以政府信息共享制度推动政府公报电子化。

The establishment and perfection of the Government Gazette system help promote the government information publicity and the public participation in administrative decision-making,and ensure the effectiveness of laws and regulations.The Chinese Disclosure Bill of Government Information has defects such as the equivocal legal status of different government information carriers and the lack of supporting laws and regulations.The institutionalization and systemization of 'The Federal Register' in the United States has made the Government Gazette System an important component of the modern government information disclosure system.We should learn from 'The Federal Register' to promote the rule of law in China's government information disclosure.First of all,we should define the citizens ’ right to know in legislation;secondly we should draft The Government Gazette Law;thirdly we should promote the electronic bulletin of government gazette based on the government information sharing system.
