构建农村社会养老保险政府责任的法律机制

The Construction of the Legal Mechanism of Governmental Responsibility in Rural Social Endowment Insurance

随着市场经济的发展,传统农村养老所依赖的土地、家庭和集体经济等方面功能均在弱化,传统农村养老模式备受挑战。政府在农村社会养老中应承担主导责任是生存权保障基本原则的要求,也是平等性原则的要求。对比国外政府在社会保障方面的投入,我国政府在社会养老,包括农村社会养老的财政投入还是太少,根据我国财政收支状况,增加农村社会养老的财政投入是可行的。政府责任法制化应包括政府在农村社会养老方面的财政责任、政府财政责任监督实施、宣传责任、增值保值责任等方面。

With the development of market economy,land,family,and collective economy have been greatly weakened in their function and the traditional rural endowment is confronted with various challenges.The basic principle of ensuring the right to survival and the principle of equality determine the leading responsibility of the government in rural social endowment.Compared with the investment in social security of foreign governments,the financial investment of Chinese government in social endowment,including rural social endowment,is still deficient.The financial revenue and expenditure in China prove the feasibility of increasing the financial investment in rural social endowment.This paper studies governmental responsibility on the legal level,i.e.the legalization of governmental responsibility,including its financial responsibility in rural social endowment,the supervision of its implementation,the propaganda responsibility and the responsibility to maintain and increase its value.
