非法行医刑事司法与行政执法衔接工作机制相关问题思考——以上海市浦东新区人民检察院的考察为视角

Thinking over the Link between Criminal Law Enforcement and Administrative Law Enforcement Concerning the Illegal Practice of Medicine——From the Perspective of People’s Procuratorate of Pudong New Area’s Crime Practice

非法行医行为严重扰乱医疗服务市场秩序和社会治安,危害群众的身体健康和生命安全,历来是卫生行政部门和司法机关打击的重点。我们从上海市浦东新区非法行医犯罪案件的现状考察入手,探讨行政执法与刑事执法衔接的相关问题,从法律衔接和工作衔接两方面提出完善建议,以期能对深入推进非法行医专项治理工作有所裨益。

The illegal medicine practice not only seriously disrupts the medical service market order and social order, but also is harmful to people＇s health and life safety. The Health Administrative Departments and Judicial Authority have been fighting against it. This paper tries to discuss the cohesion of the administrative law enforcement and criminal law enforcement from the status of Pudong New Area＇s crime practice of case. It will suggest two links concerning law enforcement and management.
