环境产业是满足用户的环境需求并创造经济价值的产业。完善的法律制度是迅速催生并保障日本环境产业发展的关键因素。相较日本,中国现有的循环经济法律体系有待健全和完善;循环经济立法定位不明确,循环经济参与主体责任缺失;配套的法律保障机制不到位。为促进中国经济产业转型,应健全循环经济立法体系,填补立法空白;转变循环经济立法定位,明确循环经济主体责任;完善现有循环经济保障机制,增进循环经济发展动力;丰富循环经济发展形式,扩大参与主体。

Environmental industry meets the user＇s environment needs and creates economic value. Sound legal system is the key factor that ensures the rapid development of Japan＇s environmental industry. Compared to Japan, there are many areas that might to be improved and perfected in China＇s current legal system of circular economy： the positioning of circular economy legislation is not dear, and the main responsibility is missing; the supporting legal protection mechanism is un- sound. To promote Chinese economic transformation, we should sound the legislative system of circular economy, to fill legislative gaps; transform the positioning of circular economy Legislation, and clearly define the main responsibility; improve the existing safeguard mechanisms to promote the development of circular economy; enrich the development form, and expand the participating subjects.
