知识产权的动态概念初探——基于过程主义的定义哲学

On the Dynamic Concepts of Intellectual Property Rights——A Definition Philosophy Based on Processualism

传统的知识产权概念均为静态的法律概念,其定义方法为列举主义和概括主义。而作为定义哲学的过程主义,其思想有两个:(1)将定义作为一个概念的生成过程;(2)将被定义项定义为一个活动过程。本文经过实践体验——理论先导——文献分析——概念定义的四个阶段过程,尝试着定义知识产权的动态概念。即知识产权是创造性知识的产权运行过程。该概念突显过程性、管理性、系统性。它对于知识产权的本质认识、理论创建、实践引领,均具有一定的理论意义和应用意义。

The traditional concepts of intellectual property are static legal concepts, the definition meth- ods of which include enumeration and generalization. Processualism, defined as definition philosophy, has two thoughts as follows, a） the process of generating definitions as concepts, b） the process of defi- ning objects as activities. In this paper, the dynamic concepts of intellectual property will be discussed via four stages, that is, practical experiencing, theory initializing, document analyzing and concept defi- ning. Intellectual property is the process of operating property rights of creative knowledge, and proces- sity, management, systematicity are emphasized in this concept. It has theoretical and practical mean- ings in understanding the essence, theory creation, and practical pioneering of intellectual property rights.
