摘要
继2004年《宪法》规定"国家尊重和保障人权"之后,2012年《刑事诉讼法》修改将"尊重和保障人权"写进法典,我国实现了从"人权入宪"到"人权入法"的立法转变。如何在立法和司法层面落实"国家尊重和保障人权"的基本要求,是一个需要持续关注的问题。对宪法与刑事诉讼法的关系进行历史考察和理论解读,揭示2012年《刑事诉讼法》修改在两法关系方面的进步及存在的问题,以促进两法关系的未来发展。
The Constitution (2004) provides that "The state respects and safeguards human rights", and The Amendment of the Criminal Procedure Law (2012) does the same. Thus, China has realized the legislative transformation from "writing human fights into the Constitution" to "writing human rights into the criminal procedure law". How to implement the basic requirements to make sure that "The state respects and safeguards human rights" at legislative and judicial levels is an issue needing our continued concern. This article makes a historical investigation and a theoretical explanation about the relationships between the Constitution and the criminal procedure law in order to fully understand progress and existing problems in The Amendment of the Criminal Procedure Law (2012) and to promote furore development of the relationships between the two laws.
