《中华人民共和国消费者权益保护法修正案(草案)》拟设立消费公益诉讼制度,赋予消协提起消费公益诉讼的职能,这是对《民事诉讼法》的响应,也是对消费者权益保护诉讼的重大突破。建立健全消费公益诉讼制度可以更好地发挥《消费者权益保护法》的作用,维护社会经济秩序,维护消费者合法权益,促进社会主义市场经济健康发展。

The Draft Amendment to the Law of the People＇s Republic of China on the Protection of Consumer Rights and Interests is to establish a system of public interest litigation concerning consumer rights and interests, which endows consumer associations with the function of initiating public interest litigation concerning consumer rights and interests. This is a response to The CivilProcedure Law and a great breakthrough in the litigation for protecting consumer rights and interests as well. The establishment and perfection of such a system may give better play to The Law on the Protection of Consumer Rights and Interests, maintain economic and social order, safeguard legitimate rights and interests of consumers and promote the healthy development of socialist market economy.
