On the Supervision Intention

监督犯包括监督故意犯罪和监督过失犯罪。监督故意犯罪既不是间接正犯,也区别于不作为犯。监督故意不能是直接故意,而是一种特殊的间接故意;在监督故意的罪过心理中,冷漠以待的情感态度居于罪过心理的主导方面,因而它属于冷漠型情感罪过。监督故意犯罪的成立,以监督义务的存在为前提。对监督故意的分类需要通过对监督故意犯罪的分类来实现。

Supervision crime contains supervision intentional crime and supervision negligence crime.Supervision intentional crime is an indirect principal offender and it is also different from the crime of omission.Supervision intention is not direct intention,but a special kind of indirect intention.In the supervision intention,feelings indifference is the dominant aspect of the psychological attitude,and therefore it also belongs to the indifferent type of culpability.The establishment of supervision intentional crime is based on the supervision obligations as a precondition.Classification of supervision intention can be fulfilled through the classification of supervision intentional crime.
