当代俄罗斯取得时效制度的立法与实践以及对我国立法的启示

On Contemporary Russian Legislation and Practice of Praescriptio Aquisitiva and Its Enlightment to China’s Legislation

在20世纪90年初期俄罗斯的现代化转型过程中,取得时效制度重新出现在俄罗斯法中,但是由于苏维埃立法的特殊性导致取得时效制度在俄罗斯的司法实践具有较强的特殊性,尤其是在取得时效构成要件的认定、取得时效期间的计算和取得时效案件的程序适用上,凸显了转型国家在法律制度转换过程中的艰辛。

Praescriptio Aquisitiva was re-appeared in Russia Law in the early 90s of the 20th century. Howev- er,enormous difficulty which especially turns out in some aspects such as identification to elements of Prae- scriptio Aquisitiva,the calculation of Praescriptio and also the application of usucapio procedure that due to special nature of the Soviet legislation was manifested in conversion process of legal system in such transition country.
