监狱形态中管理理念的向度阐释——以《监狱设计标准》的修订为视角

Interpretation of the Management Concept of Prison Form from Different Angles——From the Perspective of the Revision of“Designing Standards for Prison”

不同的历史时期,监狱呈现出具有时代特色的形态,监狱形态蕴含着监狱的管理理念,我国《监狱设计标准》的修订为监狱布局调整提供了项目论证、决策、实施的重要依据。同时,所体现出的监狱管理理念主要有分类建设和分类管理的理念、规模适度的理念、过程管理的理念、安全稳定的理念、以教育改造为中心任务的理念、对监狱人民警察人文关怀的理念、保障罪犯合法权益的理念等。这些理念的落实面临主观和客观两方面的困难。监狱形态不是单一的建筑问题,它折射了监狱刑罚理念、法治思想、社会文化和社会文明,因此,与时俱进,有必要探索监狱形态设计新的发展路径。

In different historical periods, prison has different forms with era characteristics, which contain differ- ent management ideas. The revision of ＂Designing Standards for Prison＂ offers important basis for the project reasoning, decision making and implementation of the layout adjustment. Meanwhile, management concept it re- flects mainly include such concepts as classified construction and classified management, moderate scale, process management, security and stability, education-oriented reform as the main task, the police＇ s humanistic care of the prisoners, guarantee of the lawful rights and interests of the prisoners, etc. The implementation of these concepts will face with both subjective and objective difficulties. The form of prison is not only the prob- lem of a single building. It also reflects the penalty concepts, the thought of rule of law, the social culture and the social civilization. To keep pace with the times, we thus need to explore a new development path for the de- sign of prison form.
